Molesting girl, 11: Guard jailed

Kota Kinabalu: A 28-year-old security guard who committed sexual assault against an 11-year-old girl, was sentenced to nine years' jail and ordered to get a stroke of the cane.

Abu Hurairah Eddie received the punishment from Sessions Court Judge Ainul Shahrin Mohamad after he pleaded guilty to the charge against him on Thursday.

Ainul also ordered Abu to undergo rehabilitative counselling while in prison and placed under police supervision for a year after completing his jail sentence.

Abu had forcedly kissed the minor's left cheek at 6.30am on July 13, this year, at a toilet in a government department's security hut in Putatan.

The offence under Section 14(a) of the Sexual Offences Against Children Act 2017 provides for a jail term of up to 20 years, and whipping, on conviction.

In applying for a light sentence, Abu, who was not represented, told the court that he is single but needed to support his parents and three siblings.

However, Deputy Public Prosecutor Rustam Sanip urged the court to hand down a heavy sentence taking into consideration the rampancy of the case involving minors.

Rustam said a deterrent sentence would not only give a lesson to Abu but to deter the public at large from committing the same offence so that children's safety could be protected.

The facts of the case stated that the girl was on her way to school when Abu called her and asked her father's name in front of the toilet.

While she stopped to talk to Abu, he dragged her into the toilet where he kissed the girl.

She shouted for help but no one heard her.

Abu asked the girl to remain silent and told her that he would pay her.

The girl managed to escape and returned home where she revealed the incident to her mother.

Following a police report lodged by the girl, Abu was arrested. - Cynthia D Baga
