Man gets 12 months for assaulting sister

Kota Kinabalu: A 27-year-old man was sentenced to 12 months jail for assaulting his sister, who chided him for ill-treating their father.

Nelson Nicolas admitted before Magistrate Cindy Mc Juce Balitus to causing hurt to one Natalia Nicolas, 23, at 7pm on March 26 in a house at Kg Kituau in Penampang.

Inspector Albert Basiri, prosecuting, told the court that prior to the incident, while Natalia was in their grandmother's house, a heated argument ensued between her and Nelson because Natalia criticised him for scolding their father.

Nelson punched Natalia's head, arm and kicked her leg, said Albert.

The offence under Section 323 of the Penal Code provides for a jail term of up to a year or fine or both conviction.


In another case, two men were jailed 12 months for disposing of a stolen motorcycle's frame.

Mohd Hardi Hassan, 23, Mohd Shafiq Shazreen John, 21, pleaded guilty to committing the offence at 8.20pm on April 19 at a drain along Jalan Tuaran Bypass.

The court heard that the motorcycle was reported missing on April 9 here.

Meanwhile, an entertainment outlet owner, who operated the premises without a licence was fined RM4,500 or six months jail.


Aldrianus Francis, 32, pleaded guilty to running the business of the D'Hauss Karaoke and Fun Pub at Tamparuli Point, Inanam at 2.30am on Dec 24, 2017.

The court heard that the police raided the outlet and found that music was still played and that there were 21 customers still inside the premises.

Police later found that the premises has no licence for the business, said prosecuting officer Inspector Papilus Primus.

The offence under Section 3 of the Public Entertainment Ordinance 1958 provides for a fine of up to RM50,000 or up to one year jail or both on conviction. - Jo Ann Moo
